통일된 한반도의 헌법에서 수도조항의 필요성에 대한 고찰
통일에 대한 많은 논의 중 수도와 관련한 논의 또한 중요하다. 남한과 북한 사회에서 수도는 정치, 경제, 사회, 문화의 전 영역에 걸쳐서 굉장히 중요한 기능을 담당하고 있고 따라서 양 국가에서 수도의 소재지 문제도 굉장히 중요하고 민감한 사항이기 때문이다. 실제로 한반도 통일 과정 중 수도 결정의 문제는 복잡하고 어려운 문제가 될 가능성이 아주 높을 것이다. 이러한 문제를 해결할 수 있는 좋은 방법 중 하나가 국민적 합의의 결과물로 헌법에 명문으로 수도조항을 두는 것이다. 독일의 경우 통일시 수도선정 문제와 관련하여 많은 논의가 이루어졌고, 기본법에 수도규정을 신설함으로 이 문제를 최종적으로 마무리하였다. 기본법에 수도조항을 신설함으로 통일을 완성하고, 이를 통해 수도 베를린을 발전시키기 위한 헌법적 전제를 마련하였다. 이러한 역사적 경험을 타산지석 삼아서 통일 과정에서의 수도조항에 대한 논의를 진행하여야 한다. 우리의 경우 현재 헌법에 명문의 수도조항을 두고 있지는 않다. 하지만 헌법재판소에서 수도의 소재지가 서울이라는 관습헌법이 있음을 확인하고 이에 규범적 효력을 부여하였다. 따라서 통일 한반도의 헌법에서 수도조항에 대해 논의하려면 이 헌법재판소의 판례를 유의하여야 한다. 헌법제정의 방법으로 수도조항을 규정하는 경우 문제가 없지만, 헌법개정의 방법으로 수도조항을 신설하는 경우 헌법재판소 결정의 효력으로 인해 발생할 수 있는 여러 문제를 고려하여야 한다. 그리고 소위 분리수도를 통해 문제를 해결하고자 하는 경우도 마찬가지로 헌법재판소 판례를 고려하여야 한다. 그러함에도 불구하고 남북이 통일하는 과정에서는 헌법재판소 판결의 효력도 중요하지만, 국민의 의사가 더 중요하게 존중될 필요성이 있음을 간과해서는 안 될 것이다.
Discussion of the need for the capital clause in the Constitutional Law of the United Korean Peninsula
When we discuss reunification of South and North Korea, it is important how to determine the capital and where is designated as a capital. In South and North Korean society, the capital plays a very important role in all areas of politics, economy, society and culture. Thus the issue of capital decision will become one of the biggest issues in the course of the Korean Peninsula Reunification process. A good way to solve this problem is to add a capital clause to the constitutional law as a result of national consensus. In the case of Germany, it was decided to insert a capital clause to the ‘Grundgeset’ after intense debate. The case of Germany shows us a good example of how to handle the capital clause in the reunification process. However, the constitutional court confirmed the existence of unwritten constitutional law over capital clause and gave the capital Seoul a normative effect. In order to discuss the determination of the capital of the united Korean peninsula, this decision of the constitutional court must be observed. In particular, when determining a capital clause as a constitutional amendment, various aspects that may result from the effect of the decision of the constitutional court should be taken into account. Nonetheless, the most important thing of a process of capital decision is that it should be made based on the national consensus.
