Forschung zum Verfassungsrecht Südkoreas : Fokus Verfassungsgericht
이 글은 한국 헌법과 헌법재판의 사례를 연구하고자 하는 비(非)한국어권, 특히 독일어 권 외국인들에게 관련 법률 자료를 조사하는 방법을 소개한다. 이 글의 목표는 위와 같은 독자를 대상으로 한국의 헌법재판소가 제공하는 관련 자료를 조망하고 체계적으로 검토하는 것이다. 지난 30년을 되돌아 보면, 한국의 헌법재판소가 한국의 헌법 체계에서 그 역할을 확대하고 안정화함에 따라, 한국 헌법에 관련된 기초 자료가 한국 헌법재판소의 노력으로 상당히 증가했다. 독일연방헌법재판소와 미국연방대법원이 세계적 수준에서 주목 받는 것과 마찬가지로 아시아 지역에서 헌법재판을 주도하는 기관이 되기 위한 한국 헌법재판소의 모색 과정에서 비(非)한국어 출판물의 범위는 더욱 확대될 가능성이 있다. 한국의 헌법 및 헌법재판에 관한 연구는 2017년 서울에 아시아헌법재판소연합의 상설 연구사무국이 설립된 이후로 중요성이 더 커지고 있다. 따라서 한국 헌법에 관한 외국인 연구자들의 연구 자료의 확대도 가까운 미래에 예상된다. 이 글에서는 먼저 한국의 헌법 제도 하에서의 한국 헌법재판소의 지위를 역사적 제도적 맥락 속에서 파악한 다. 그 다음에 헌법재판소의 관할권에 대한 논의와 판례 등 사례 인용 체제에 대한 정보를 제공한다. 판례법을 넘어서는 여타의 연구 자료에 대한 조사방법도 소개된다. 마지막으로, 이러한 헌법 연구 자료의 가용성과 그 성장의 잠재성을 평가한다. 이전의 한국과 독일 사이의 비교법학연구가 주로 독일의 법과 법리를 한국인 학자들이 연구하고 참고하여 왔다면, 최근에는 역방향의 요청도 생겨나고 있다. 이러한 새 경향은 독일과 한국의 법학적 학술교류가 일방향적인 면에서 점차 쌍방향적 학문 교류로 나아갈 수 있고 이러한 쌍방향성이야말로 진정한 학문 교류이자 학문적 성취의 질을 대폭 강화시킨다 는 점에서 큰 의미가 있다고 하겠다.
Researching Constitutional Law in Korea : Focusing on the Constitutional Court
This article introduces Korean legal materials to German speakers wishing to undertake the study of Korean constitutional law and cases. The aim is to highlight relevant material provided by the Constitutional Court of Korea (CCK). Looking back over the last three decades, as the CCK has expanded and stabilized its role in the Korean constitutional system, the basic materials available on Korean constitutional law have grown in volume, partly due to the CCK’s efforts. In the CCK’s quest to become a leading court of constitutional adjudication in the Asian region, comparable to the positions of the German Federal Constitutional Court and the US Supreme Court on the world stage, its range of publications in English can be further expanded. Research on Korean constitutional law and cases will gain in significance since the permanent Research Secretariat of the Association of Asian Constitutional Courts and Equivalent Bodies was established in Seoul in 2017. Therefore, an expansion in available research materials on Korean constitutional law is to be expected in the near future. An overview of the position of the CCK in South Korea’s constitutional system provides institutional context. This is followed by a discussion of CCK jurisdictions and their links to the case citation system. Research materials beyond case law are also introduced; finally, an assessment is made of the availability and potential growth of constitutional research material.
