경쟁에 있어 수요자로서 국가의 역할 : 독일 경쟁제한방지법 제4부를 중심으로
현재 우리 국가 정책은 성장 지향적 경제 정책에서 장기적 관점에서의 사회적 · 생태적 · 경제적 이익 추구로 패러다임의 전환이 이루어졌고, 이 맥락에서 가령 지속가능한 성장 전략은 우리 국가 행정의 핵심 아젠다 중 하나이기에, 이를 실질적으로 달성하기 위한 적절한 도구가 모색되어야 한다. 이때 우리 국가 행정은 지속가능한 성장 목표를 실질적으로 달성하기 위한 행위 형태로 경쟁을 발견하고 이를 수단으로 활용하는 방식을 적극 추진하고 있다. 여기서 무엇보다도 국가 수요시장에 지배하는 경쟁이 지속가능한 성장 전략을 위해 도구화되고 있다. 그러나, 이러한 방법론을 추구하는 데 있어 경쟁 과정에 미치는 영향이 충분히 고려되지 않는다면, 관련 재화 시장에 경쟁이 왜곡될 수 있다. 따라서, 그러한 정책 지향적 목표 달성을 현실화하기 위해 경쟁친화적이고 경쟁중립적인 수단이 선택되는 것은 중요하다. 이 배경에서 본고의 목적은 독일 경쟁제한방지법 제4부에 기초하여 어떻게 수요자로서 국가가 경쟁친화적인 방식으로 지속가능한 성장 전략을 효율적으로 달성할 수 있는지를 밝히는 데 있다.
The role of the state as a demander in economic competition : Focus on German Public Procurement Law
As part of the current South Korean government policy, there has been a paradigm shift from a growth-oriented economic policy to social, ecological and economic development with a long-term perspective. Against this background, one of the guiding principles of Korean government policy is the promotion of sustainable development. Competition was and is actively used to achieve sustainability goals. In particular, competition in the award of public contracts was used as an instrument for achieving the sustainability goals. However, if the effects on the competitive process are not sufficiently taken into account when instrumentalizing the award competition, competition on the relevant market can be noticeably impaired. In this context, based on the German cartel procurement law, this study is intended to show how the Korean state as a customer can implement a sustainable strategy in a competition-friendly manner.
