Bodenneuordnung in Ostdeutschland : Ansprüche auf Eigentumsrückgabe und Entschädigung aufgrund von Enteignungen und Lehren für den Fall einer koreanischen Wiedervereinigung
본 논문은 동독의 산림과 농경지가 1945/46년에 몰수되어 재분배된 과정을 독일 통일을 거쳐 오늘날에 이르기까지 역사적, 정치적 그리고 법적 관점에서 고찰하였다. 독일통일 후 많은 토지가 연방 정부에 의해 보상 없이 수용되었고, 이전의 대지주에게는 이전 토지를 저렴하게 다시 취득 할 수 있는 유리한 기회가 주어졌다. 대지주들이 예전 토지를 그들이 원했던 것처럼 무상으로 돌려받지는 못했지만, 바라던 대로 정치적인 과정을 통해 아주 저렴하게 토지를 다시 매입할 수 있었다. 공공 재산이 헐값에 매각되었기 에 이 거래에서 패자는 독일 연방 공화국의 시민이었다. 보상 없는 소농의 토지 몰수와 이전의 대지주에 대한 혜택 모두는 연방 의회에서 CDU/CSU, FDP 및 녹색당이 통일 후 내린 정치적 결정이었다. 이는 성공적인 로비 작업의 결과라고 할 수 있다. 이 논문은 서론(I) 후 먼저 후기 동독(II) 지역에서 수용의 역사적 배경에 대한 개요를 정리하고, 1945년과 46년의 법적 상황(III)과 다음으로 1945년부터 1949년까지의 통일 과정에서 수용의 대상이 어떻게 정치적 법적으로 다뤄졌는지(IV), 그리고 통일 이후에 이러한 처리와 관련하여 어떠한 법적 분쟁이 발생하였는가를 살펴보았다. 마지막(V)으로 이 독일 역사가 통일한국에 어떤 시사점을 줄 지도 살펴보았다.
동독 지역의 토지 개편 : 수용 토지의 반환 및 보상 청구와 통일한국에의 교훈
The following article examines the history of the agricultural and forestry land in East Germany, from the expropriation and redistribution in the years of 1945/1946 over the years of the reunion to our time, from a historical, political and judicial point of view, as also which lessons for Korea from this part of German history. After an introduction (I.), the article offers a summary about the historical background of the expropriations on the territory of the becoming German Democratic Republic (GDR) before giving a display of the practice of the expropriations and the following legal reorder (II.). Hereinafter, the article assumes the political and judicial handling of the expropriations from 1945 in the course of the German reunification (III.) and which legal disputes appeared after the German reunification because of this handling. (IV.). In conclusion, the article reconsiders lessons from this development.
