민주와 공화 사이에서 – 보댕 및 루소의 주권론과 혼합정체론의 조화
본 연구의 목적은 주권개념과 혼합정론이라는 민주와 공화의 핵심 개념을 분석하고 그 상호관계를 밝히는 것이다. 주권개념은 단일성과 절대성을 그 특징으로 가지고 있다. 최고 권력으로서 배타적 지배권을 갖고 있는 것이다. 주권론에서는 주권자의 의지와 그것을 통한 권력의 행사가 중요해 진다. 주권자는 최고의 통일적 지배권을 배타적으로 행사하는 유일한 주체인 것이다. 결국 주권론의 특성은 절대성, 통일성, 순수성, 그리고 배타적 지배이다. 혼합정체론은 권력의 분점 및 견제와 균형을 통해 어느 한 세력이 절대적 우위를 점하는 것을 지양한다. 다양한 세력과 그들을 대변하는 제도의 확립을 통해 권력의 독점과 그 배타적 행사를 제어하고자 한다. 이 혼합정체론이 공화의 핵심개념이다. 권력의 독점이라는 민주와 권력의 분점이라는 공화는 긴장관계에 있다고볼 수 있다. 하지만 공화는 민주의 보존에 기여할 수 있다. 왜냐하면 민주가 국민 모두의 주권을 주장하는 것이라면 모두에 대한 배려가 필요하고, 권력의 분점은 공존을 지향하기 때문이다. 하지만 민주의 주권의식이 강화되어 과도한 권력요구로 나타날 때, 대립과 배제 그리고 억압을 낳게 되어 공화를 저해할 수 있다. 공화의 권력분점과 균형에 대한 모색을 통해 민주의 진정한 실현을 모색하는 것이 ‘민주공화’의 핵심적인 문제의식이다.
Between Democracy and Republicanism - Harmonization of Bodin's and Rousseau's Theory of Sovereignty and the Mixed Constitution's Theory
This study aims to analyze the core concepts of democracy and republicanism, that is, sovereignty and mixed constitution, and to reveal its interrelationships. The concept of sovereignty features unity and absoluteness. As the highest power, it has exclusive control power. In the theory of sovereignty, the exercise of the sovereign’s will and his power becomes important. The sovereign is the only one who exclusively exercises the highest unified control power. After all, the characteristics of sovereignty are absoluteness, unity, purity and exclusive domination. The theory of mixed constitution avoids the fact that any one power has an absolute advantage through the division of power and check and balance. It seeks to control the monopoly of power and its exclusive exercise through the establishment of various forces and systems that represent them. This mixed constitution theory is the key concept of republicanism. The democracy of power monopoly and the republic of power division are in tension. But republicanism can contribute to the preservation of democracy. This is because if democracy claims the sovereignty of all people, consideration is needed for all, and the division of power aims for coexistence. However, when the sovereignty of democracy is strengthened and appears as an excessive demand for power, it can lead to conflict, exclusion and oppression, which can hinder republicanism. The search for the realization of democracy through the search for the power division and balance of the republicanism is the key problem consciousness of the 'Democratic Republicanism'.
