Kritische Analyse des deutschen Netzwerkdurchsetzungsgesetzes und Gesetzesvorschläge für die Regulierung von sozialen Netzwerken
독일의 „소셜네트워크에 있어 법운용의 개선을 위한 법률 (Gesetz zur Verbesserung der Rechtsdurchsetzung in sozialen Netzwerken, Netzwerkdurchsetzungsgesetz)“ - 즉 네트워크운용법 - 은 소셜네트워크에 등장하는 혐오발언 또는 페이크뉴스를 규율하기 위한 목적으로 2017년 10월 1일부터 효력을 발휘하고 있다. 네트워크운용법은 네트워크 상 혐오범죄와 가벌적 내용들에 효과적이고 빠르게 대응할 수 있도록 소셜네트워크를 규율하는데 필요한 새로운 내용들을 담고 있다. 네트워크운용법의 타당성에 대하여는 독일 기본법과 관련하여 논란이 되고 있고 규제의 접근방식에 대하여도 비판이 이어지고 있기는 하나, 동법은 한국에서 소위 페이크뉴스에 관한 문제들의 규율을 위한 법적 근거를 마련하기 위한 논의과정에서 선례로 작용하고 있다. 본 논문은 한국에서 페이크뉴스의 규율을 위한 입법적 논의를 하는 데 있어 참조가 되고 있는 독일 네트워크운용법에 내재되어 있는 법적 문제들을 해결하기 위하여 필요한 내용들을 제안하는데 중점을 두고 있다. 이를 위하여 본 논문은 네트워크운용법의 도입이 유, 기본적인 내용 및 주요하게 언급되는 법적 문제들을 다루는 한편, 새로운 규제방식의 이행과 관련된 첫 번째 보고내용들은 물론 관련 판례의 입장들을 분석함으로써, 종국적으 로 네트워크운용법의 개정을 위한 구체적인 방안들을 언급하고 있다.
Critical analysis of the German Network Enforcement Act and legislative proposals for the regulation of social networks
The German „Act to Improve Enforcement of the Law in Social Networks (Network Enforcement Act)“, which aims to combat Hate Speech and Fake News in social networks, entered into force on 1 October 2017. The German Network Enforcement Act includes a novel approach to the regulation of social networks to contain hate crime and other criminal content on the internet effectively and immediately. However, the compatibility of the law with the German Basic Law is controversial and also the functionality of the regulatory approach attracts criticism. Nevertheless, the law serves as a model for the development of legal regulation in South Korea by means of which the Korean legislator intends to specifically regulate the social media with respect to so-called „Fake News“. This paper focuses on the concrete proposals for removing the main shortcomings of the legislation which are also intended to contribute to the discussion on the regulation of social networks in South Korea. Concretely, the paper presents the reasons for the introduction of the Network Enforcement Act, the essential content of the Network Enforcement Act, the main legal problems of the legislation and analyses the first experiences und relevant judgements regarding the new regulatory approach of the Network Enforcement Act. Finally, the paper submits proposals for the revision of the Network Enforcement Act.
